1. OVERVIEW
This Domain Name Transfer Agreement (this “Agreement”) is signed between you and Hostlica, LLC {as Hostlica} in Turkey, or in the case of a .ca domain name, West Domains Canada, Inc., a British Columbia corporation. (each " Hostlica "") and enters into force as of the date of electronic acceptance. This Agreement sets out the terms and conditions for you to use Hostlica Domain Name Transfer services (Services) to transfer a registered domain name from another domain name registrar to Hostlica as a domain name registrar. This Receiving the Agreement electronically indicates that you have read, understood, approved and agreed to be bound by the Universal Terms of Service Agreement, Domain Name Registration Agreement and Uniform Domain Name Dispute Resolution Policy referenced herein along with this Agreement.
Terms like “we”, “us” or “us” refer to Hostlica. “You”, “your”, “User” or “customer terms” means the person or entity that has accepted this Agreement. Nothing in this Agreement shall be deemed to confer any third-party right or advantage.
Hostlica may, at its sole discretion, change or amend this Agreement, any policies or agreements appended to this document at any time, and such changes or amendments will become effective immediately after they are posted on the Hostlica site (this “Site”). (i) You may be notified by Hostlica of such changes or modifications by posting on this Site, and (ii) you will be able to access this Site or the Services available on this Site after such changes or adjustments are made (as indicated by the "Last Updated" date at the top of this page). You acknowledge and agree that your use of this Agreement will constitute your acceptance of the latest version. If you do not agree to be bound by this Agreement as of the last update, this Site or the Services available on this Site' Do not use (or continue to use) In addition, Hostlica may notify you of changes or amendments to this Agreement from time to time by e-mail. Therefore, it is very important that you keep your account (“Account”) information up to date, including your email address. Hostlica assumes no responsibility or liability for your failure to receive an email notification if such an error is caused by an incorrect or outdated email address.
Hostlica Internet Assigned Names and Numbers Corporation is not an ICANN accredited domain name registrar; is an authorized reseller of domain name registration services. Accordingly, Hostlica's service is bound by this Agreement provided by (i) the sponsoring registrar, (ii) ICANN, and/or (iii) the applicable registrar for such top-level domain TLD or country code top-level domain ccTLD". You acknowledge and agree that registration as used in this Agreement, Registrar, registrar or Registrar means the current registration for such TLD or ccTLD. This Agreement will be valid following the acceptance of the Agreement and Transfer agreements in Step 3 of the Online Transfer Application process.
2. TRANSFER PROCESS OF ALL DOMAIN NAMES EXCEPT .CA DOMAIN NAMES
2 A. Steps to Transfer Your Domain Name Registration
NOTE: As soon as the transfer is complete, you can REFRESH, CHANGE your DNS and use other functions by logging into the Account Manager. Completion of all necessary information required for the online transfer application, such as contact information, server name information. Continue with the shopping cart and pay for your transfers. Update the Admin Contact email on your current record. We will contact the Admin Contact email for transfer confirmation. The transfer will only begin with the approval of the Admin Contact. Transfer will be accepted or rejected within five (5) days after approval.
2.B. Failed or Rejected Transfer Requests
Hostlica, in its sole discretion, may accept or reject your domain name transfer application for any reason. Rejections may include, but are not limited to:
The current Domain Registrar has refused the transfer;
The original registration took place sixty (60) days before the transfer request;
Locked status by the registrar or the unregistered registrar;
The domain name was transferred to Hostlica sixty (60) days before the transfer request;
The domain name has expired but not renewed;
The domain name has expired and was renewed during the forty-five (45) day waiting period and the forty-five (45) day waiting period has not yet passed;
The Registrant has changed sixty days before the transfer request;
Account Change was made ten (10) days before the transfer request;
The current registrant is in bankruptcy;
Any disputes over the domain identity holder;
The emergence of any situation described in the Agreement Principles; or
Transfer orders exceeding thirty days.
2.C. Transfer Terms of Domain Names
After the transfer is successful, you remain the registrant of the domain and Hostlica's sponsoring registrar becomes the registrar of the registration. Your registration is automatically extended for one (1) year where applicable (see product disclaimers found on this Site for exceptions). Domain name registration transfers can only be initiated once acceptance of this Agreement has been confirmed, payment has been made, and the Administrator Contact has responded positively to our email requesting Transfer Permission. Email is sent requesting Transfer Permission to Domain Names Admin Contact based on previous Domain Name Registrar data in WHOIS database. It is your responsibility to keep the receipt of the purchase of your domain name. The Admin Contact person acts on behalf of the Registrant and has the legal authority to request a transfer.
2.D. Transfer of Recently Renewed Domain Names
If you are transferring a recently renewed domain name, you understand that the renewal year is likely to be the lost year. (i) If the domain name is renewed during the forty-five (45) day waiting period after the expiry, (ii) if the forty-five-day period from the expiry date has not yet passed, the renewal year will be lost. You agree that Hostlica will not be held responsible for this lost year and that Hostlica will not reimburse you for this year. You will need to review the registration agreement with the previous registrar to find out if you are a creditor or debtor for the lost year. If you have questions about the lost year, contact the domain registrar.
You understand that this is a domain name transfer request from domain registrars. By accepting this agreement, you request the transfer of the domain name registration from the existing registrar to Hostlica. As the current authorized Domain Name Owner of domain names, you agree to authorize the transfer by notifying the Admin Contact Person of their responsibilities for this transfer. You confirm that you have made a Domain Name Registration Agreement with Hostlica. 3 A. Steps to Transfer Your Domain Name Registration NOTE: You can RENEW, CHANGE YOUR DNS and use other functions by logging into your Account Manager
as soon as the transfer is complete . Completion of all necessary information required for the online transfer application, such as contact information, server name information. Continue with the shopping cart and pay for your transfers. Update the Admin Contact email at your current registrar. We will send the transfer confirmation e-mail to the e-mail address specified in your account. As soon as the correct authorization code is provided, the transfer will be initiated.
3.B. Failed or Declined Transfer Requests
Hostlica may, in its sole discretion, accept or reject your domain name transfer application for any reason. Rejections may include, but are not limited to:
The original registration took place sixty (60) days before the transfer request;
The domain name has been locked by the registrar or the unregistered registrar;
The domain name was transferred to Hostlica sixty (60) days before the transfer request;
The domain name has expired but not renewed;
The domain name has expired and was renewed during the forty-five (45) day waiting period and the forty-five (45) day waiting period has not yet passed;
The Registrant has changed sixty days before the transfer request;
Account Change was made ten (10) days before the transfer request;
The current registrant is in bankruptcy;
Any disputes over the domain identity holder;
The emergence of any situation described in the Agreement Principles; or

3.E. Domain Transfer Data
You understand that this is a domain name transfer request from domain registrars. By accepting this agreement, you request the transfer of the domain name registration from the existing registrar to Hostlica. You confirm that you have made a Domain Name Registration Agreement with Hostlica. the Domain Name Registration Agreement, the ICANN Uniform Domain Name Dispute Resolution Principles , which governs all domain names registered with ; this Agreement; You agree to read, understand and be legally bound by all agreements on the legal agreements page, including the Hostlica policies published by Hostlica and may be published from time to time.
4. HEADINGS AND HEADINGS; INDEPENDENT COMMITMENTS; SEPARABILITY
The headings of this Agreement are provided for convenience and ease of reference only and will not be used to explain or interpret the parties' agreement in any way not specified herein. Each term and contract in this Agreement will be reviewed for all purposes as a separate and independent clause or contract. If a court of competent jurisdiction finds that any provision (or part of a provision) of this Agreement is unlawful, invalid or unenforceable, the other provisions (or portions of provisions) of this Agreement will not be affected and will be valid and enforceable to the fullest extent permitted by law.
5. DEFINITIONS; Contradictions
Capitalized terms not defined in this Agreement shall have the meanings ascribed to them in the Universal Terms of Service Agreement. In the event of any inconsistency between the provisions of this Agreement and the provisions of the Universal Terms of Service Agreement, the provisions of this Agreement will prevail.
